CONCERNING
THE AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE NO. 22/PMK.010/2005 ON THE EXEMPTION FROM IMPORT DUTY ON THE IMPORT OF SPARE PARTS OF PUBLIC TRANSPORT
THE MINISTER OF FINANCE,
Considering :
- a. that in the framework of fulfilling the need of affordable spare parts for the maintenance of public transport, it is deemed necessary to change kinds of spare parts imported for the maintenance of public transport;
- b. that based on the consideration as meant in letter a, it is necessary to stipulate a regulation of the Minister of Finance on the Amendment to Regulation of the Minister of Finance No. 22/PMK.010/2005 on the Exemption from Import Duty on the Import of Spare Parts of Public Transport;
In view of :
- 1. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
- 2. Presidential Decree No. 187/M/2004;
- 3. Decree of the Minister of Finance No. 545/KMK.01/2003 on Stipulation of Systems of Classifications of Goods;
- 4. Decree of the Minister of Finance No. 547/KMK.01/2003 on Stipulation of Tariffs of Import Duty on Imported Goods;
- 5. Regulation of the Minister of Finance No. 22/PMK.010/2005 on the Exemption from Import Duty on the Import of Spare Parts of Public Transport;
DECIDES:
To stipulate :
THE REGULATION OF THE MINISTER OF FINANCE ON THE AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE NO. 22/PMK.010/2005 CONCERNING THE EXEMPTION FROM IMPORT DUTY ON THE IMPORT OF SPARE PARTS OF PUBLIC TRANSPORT
Article I
The provision in Article 1 paragraph (1) of Regulation of the Minister of Finance No. 22/PMK.010/2005 on the Exemption from Import Duty on the Import of Spare Parts of Public Transport is amended so that the article entirely reads as follows:
"Article I
(1) The import of spare parts of motor vehicle consisting of:
- a. Clutch assy as many as 705,000 pieces;
- b. Timing belt as many as 1,411,000 pieces;
- c. Wheel bearing as many as 817,000 pieces;
- d. Transmission assy as many as 104,000 pieces;
- e. Engine assy as many as 104,000 pieces,
which are used for maintaining public transport is exempt from import duty so that the final tariff of import duty becomes 0% (nil percent).
(2) The goods as meant in paragraph (1) must be imported in a new condition.
(3) Stipulation of importers and allocation of the quantity and kinds of the imported goods as meant in paragraph (1) is done by the Minister of Trade on the basis of recommendation from the Minister of Transportation."
Article II
The regulation of the Minister of Finance is effective for 12 (twelve) months, starting from March 10, 2005.
For public cognizance, the regulation shall be published by placing it in State Gazette of the Republic of Indonesia.
